Cardi B, who shares three children with her estranged husband, Offset, announced she gave birth to a baby boy.However, the joyous moment for Cardi B and Diggs arrives while she remains legally married to Offset. This has led to some complicated legal questions hanging over the newborn’s paternity.According to Georgia law, Offset might be considered the legal father of Cardi B and Diggs' newborn son. As per Georgia Code § 19-7-20(a), a child born during a marriage is presumed to be legitimate, with the husband presumed to be the legal father. The presumption applies even if the couple is separated, if divorce proceedings are underway, or if the biological father is someone else.Cardi B and Offset got married in 2017. She first filed for divorce in September 2020, but later dismissed the filing after the couple reconciled.Cardi B filed for divorce from Offset a second time in July 2024.
