The antitrust trial has stirred up a media frenzy over the last few days. Hamlin began the proceedings with an emotional testimony on day 1 of the trial. The 23XI co-owner shed light on the pitfalls of owning a NASCAR team, noting how the sanctioning body poaches sponsors and offers insufficient payouts.

Executives like Steve O'Donnell and Scott Prime have taken the stand since then. O'Donnell, in particular, struggled to explain Jim France's defamatory comments about Heather Gibbs. He was also confronted over his threats to take legal action on the now-disbanded SRX series.

Despite NASCAR's best efforts, 23XI attorneys have managed to gain a leg up in the proceedings, while Michael Jordan has been in attendance since day 1. When Hamlin and Jordan exited the court after Friday's session, the former spotted a fan holding up a placard that read:

"NASCAR, your fans deserve better"

Due to a motion filed by NASCAR, Denny Hamlin is not allowed inside the courtroom during the witness testimonies. Michael Jordan, meanwhile, participates as the corporate representative of 23XI and FRM.


Denny Hamlin calls out NASCAR as a monopoly during his testimony

Denny Hamlin didn't mince words when he took the witness stand. The 45-year-old accused NASCAR of behaving like a monopoly by controlling the Next Gen package alongside the revenue distribution.

“We aren’t a monopoly. You are. I believe it’s different when you have options and drivers have options of what teams they can race for,” Denny Hamlin said(via Motorsport.com)

Legal expert Shannon McMinimee weighed in on the matter and outlined NASCAR's approach, saying,

"Depending on the witnesses temperament, there may be deliberate button pushing to get reactions. It’s often very difficult to tell in the moment how a contentious cross-examination is going over with a jury. Based on everyone’s summaries and notes, it sounds like Butterman was well prepared as was Denny."

"I suspect that there weren’t any questions that came as a surprise to him based on the summary of his answers. Which will likely be the case throughout the trial because they’re rarely are gotcha moments in civil litigation," she added.

Denny Hamlin's boss, Heather Gibbs, provided her testimony on Friday, December 5. She shared how JGR was forced to sign the charter deal under tight deadlines, a practice that she claimed was unfair towards teams. She admitted that the deal was finally agreed upon to avoid losing her late husband, Coy Gibbs' legacy.
