Veteran insider shares 3 likely “biggest hurdles” for NASCAR as antitrust lawsuit heads to court

On Monday, December 1, 23XI Racing and Front Row Motorsports will go to trial against NASCAR and its Chief Executive Officer, Mr. Jim France, in Charlotte. Ahead of the trial, veteran journalist Bob Pockrass shared a few hurdles that NASCAR could possibly face.

Back in October 2024, the NASCAR Cup Series teams filed a joint lawsuit against the sanctioning body, accusing it of alleged monopolistic practices. Notably, they were the only ones who refused to sign the latest charter agreement.

If 23XI or FRM wins the upcoming trial against NASCAR then, after District Judge Kenneth Bell determines monetary damages and antitrust remedies, anything can happen, starting from the sale of tracks to having a permanent charter system.

On the other hand, if NASCAR wins, it’s unlikely that 23XI Racing and Front Row Motorsports will stay in the racing business beyond 2026. The six charters that the officials have been holding aside until now might be sold or leased to other interested parties.

However, according to Bob Pockrass of FOX Sports, there are three potential “hurdles” that NASCAR needs to overcome in the antitrust battle. He wrote all about them in his latest post on X.

As per pre-trial documents revealed in mid-November, chartered teams receive a base amount of $185,000 for every single event. An average contending team takes home about $330,000 per race, while a top-five team earns anywhere close to $500,000. Last season, the total payout to teams was $431 million, as compared to $333 million in 2024.

For now, all eyes are on the Cook Out Clash Cup Series race at Winston-Salem’s iconic Bowman Gray Stadium. Scheduled for February 1, 2026, the 200-lap event will be televised live on FOX, with radio updates on MRN and SiriusXM NASCAR Radio.

“Our fans have been brainwashed”- 23XI Racing owner slams media publication amid ongoing NASCAR lawsuit

23XI Racing co-owner Denny Hamlin went on social media and shared his views on what he called a “propaganda piece” penned by ESPN senior NASCAR writer Ryan McGee. According to the Joe Gibbs Racing icon, McGee’s comments were meant to brainwash the fans.

As reported by McGee, team owners Hamlin and NBA legend Michael Jordan want NASCAR to give more control to the teams. The organizations receive 49 percent of the total revenue generated from NASCAR’s current media deal, which doesn’t seem enough. Jordan wants NASCAR to adopt a better revenue model under which the practice of leasing charters would be unnecessary.

“Please give credit to @mforde (Mike Forde, Racing Communications, NASCAR) for helping you write this propaganda piece that they want pushed to switch the narrative,” Hamlin wrote, replying to McGee. “Continuous lies about our stance, NASCARs motives for its actions, and continued message from the sanctioning body that everything is fine. Our fans know better.”

“Our fans have been brainwashed with their talking points for decades,” he continued. “Narratives pushed by media who are intimidated by them. Lies are over starting Monday morning. It’s time for the truth. It’s time for change.”

As per reports, the trial will continue for 10 days starting from Monday morning.
