“This is really, really unnecessary”: Insider says NASCAR could’ve avoided the entire legal disaster amid courtroom battle with 23XI, FRM

On the latest episode of the Teardown podcast, NASCAR insiders Jordan Bianchi and Jeff Gluck shared their take on the ongoing antitrust lawsuit between 23XI, FRM, and the governing body. During the podcast, both Bianchi and Gluck pointed out that this situation could have been avoided altogether.

The situation arose when both Cup Series teams refused to sign the charter agreement in October 2024. Following that, they filed an antitrust lawsuit against the governing body and accused the CEO, Jim France, of creating a monopoly in the sport. Later, the case went to trial on December 1, 2025, and it has not been settled yet.

Reflecting on the case, the NASCAR insiders claimed any settlement between both parties would include evergreen or permanent charters. They also pointed out that they were close to a settlement. However, this raises another question: why didn't the sanctioning body do this two or three years ago, which could have avoided the chaos?

Following that, Jordan Bianchi stated [00:36 onward]:

"If this is how you got there, and you're going to get, end up getting them, giving them what they wanted. You could have done this three years ago, two years ago, and if you would have done that, I can feel pretty confident in saying, if you would have given the team an evergreen charter or some kind of franchise guarantee, or like, put me you're worried about us not doing certain things, but metrics, we've got to check certain boxes to keep these charters."

Bianchi concluded, mentioning the industry's reaction, claiming the situation feels unnecessary. He added:

"It seems to be good at that. I feel pretty confident in saying that this lawsuit wouldn't have happened had that been the case; the word I keep hearing from a lot of people is unnecessary. This is really, really unnecessary."

Amid the dispute, NASCAR CEO Jim France was re-examined amid the ongoing lawsuit. During the session, he stood still against the idea of permanent or evergreen charters in stock car racing. France explained he wants to keep the sport flexible in case of a change.


Judge Bell slammed NASCAR attorneys with a warning for violating two court orders on day 3 of the trial

The lawsuit between 23XI Racing, Front Row Motorsports, and NASCAR went on trial this month. Later, on day three, the stock car racing association attorneys violated the court rules twice during the session, earning a stern warning from Judge Bell.

The sanctioning body lawyers questioned Front Row Motorsports owner Bob Jenkins about his business venture outside of stock car racing, earning the first strike. Following that, they made a text from Jeff Dickerson public, marking their second strike.

Following that, Judge Bell called out NASCAR attorneys and issued a warning to them. He stated:

"Court let out and after the jury was dismissed, Judge Bell admonished NASCAR's lawyers Twice they have violated court orders. 1) Asking Bob Jenkins about his non-NASCAR businesses when it was agreed upon in advance that it wasnt on the table and disclosing a Jeff Dickerson text message verbally when it wasnt admissible evidence. Bell said this will not be tolerated and the next time it happens, from either party, there will be significant consequences."

Previously, 23XI Racing co-owner Denny Hamlin called out NASCAR for being a "monopoly" repeatedly during his testimony on day two. He also accused the governing body of holding all the power and asking the teams to cut their expenses while retaining most of the earnings.
