NASCAR insider says Steve O’Donnell ‘flipped the script’ as Jeffrey Kessler tries to pin Jim France in the testimony

NASCAR insiders Jeff Gluck and Jordan Bianchi recently talked about day four of the trial on the Teardown podcast. During the episode, they opened up about 23XI Racing and Front Row Motorsports lawyer Jeffrey Kessler pinning Steve O’Donnell down and wanting him to blame CEO Jim France.

On day four, handwritten notes from O’Donnell were presented in court, discussing being one step ahead of the competition. Following that, Kessler questioned the governing body president for whom he wrote these notes. However, O’Donnell didn’t budge and admitted that he wasn’t referring to the France family.

Following that, Jeffrey Kessler questioned Steve O’Donnell again, this time in a loud voice. However, the NASCAR president “flipped the script,” and Gluck told Bianchi [00:42 onward]:

“Jeffrey Kessler really wants this. So he brings up again, who are you talking about? Are you talking about Jim France when you say legacy mindset hinders growth? No. Said, Well, what about these texts? You know these texts from May 2024, O'Donnell says, I don't know these texts. I don't know what you're talking about. Jeffrey Kessler says, May 2024, O'Donnell flips the script. “

“O'Donnell says, I can hear you. Basically tells the jury, hey, look at this guy. Look at Jeffrey Kessler. Jeffrey Kessler is yelling. I'm not yelling. I'm hiding by Google. I can hear you. You don't need to yell at me. It's basically what he's saying, not so many words. That was a big flip there. Think that actually almost kind of took some wind out of Jeffrey Kessler's sales, if I can make such a leap,” he added.

Also, 23XI and FRM attorney Jeffrey Kessler pressed Steve O’Donnell for mismatching claims. Earlier, O’Donnell claimed that France swore to Heather Gibbs' letter. But later, during the testimony, he backed down from his claims.


Judge Bell issued a stern warning to NASCAR attorneys for violating two court orders on day 3

23XI Racing and Front Row Motorsports’ lawsuit against NASCAR went on trial on December 1, 2025. Following the trial, on day three, Judge Bell warned the governing body lawyers for violating the court order twice in a day.

The stock car racing association lawyers questioned Front Row Motorsports owner Bob Jenkins about his business ventures outside of NASCAR. Following that, the attorneys again made a bold move and verbally disclosed a text message from Jeff Dickerson, which was not allowed as evidence, marking their second strike.

Following that, Judge Bell called out the sanctioning body’s lawyers and issued a warning. Bell stated:

"Court let out and after the jury was dismissed, Judge Bell admonished NASCAR's lawyers Twice they have violated court orders. 1) Asking Bob Jenkins about his non-NASCAR businesses when it was agreed upon in advance that it wasnt on the table and disclosing a Jeff Dickerson text message verbally when it wasnt admissible evidence. Bell said this will not be tolerated and the next time it happens, from either party, there will be significant consequences."

During day two, 23XI Racing co-owner Denny Hamlin repeatedly called out NASCAR for being a “monopoly.” Hamlin further claimed that the governing body holds all the power. Meanwhile, the teams are asked to limit their expenditure.
