Insider outlines stunning fallout if Michael Jordan’s 23XI & FRM wins antitrust case, including the end of Next Gen concept

NASCAR analyst Bob Pockrass has outlined the repercussions of Michael Jordan's 23XI Racing winning the antitrust lawsuit. The two teams are liable for 'monetary damages' determined by the jury, along with other 'antitrust remedies' decided by the federal judge.

The year-long legal dispute finally goes to trial on Monday, December 1. The outcome is bound to have wide-reaching consequences on both parties. If NASCAR wins the case, the Michael Jordan-led team will have to race as open teams, and possibly face a shutdown within a year. Pockrass shared the outcome if the two teams win instead, writing,

"If 23XI/FRM win case: -Jury determines monetary damages, only actual damages -Judge could triple that amount"

"-Judge determines antitrust remedies. Anything possible such as sell the tracks, permanent charters, no charters, get rid of Next Gen concept, no exclusivity clauses (1/3)"

23XI Racing and Front Row Motorsports have asked for permanent charters and a bigger say in financial decisions that impact teams, including monetary compensation to cover their losses thus far.

However, 23XI have been revealed to have turned a profit, unlike FRM, which has reported a $100 million loss since the team's inception. Moreover, other hurdles include higher charter payouts and increased charter valuations, which paint a less than favourable picture for the two teams.

Meanwhile, NASCAR has its own hiccups, including emails and texts showing an anti-competitive stance against rival series, exclusivity clauses for tracks and an overwhelming profit margin.


23XI finds legal loophole to keep Michael Jordan present during trial

23XI Racing were hit with a motion that prevented two of its three owners from attending the jury trial. NASCAR alleged that Michael Jordan and Denny Hamlin's popularity may sway the jury's ruling. However, 23XI have resorted to an interesting tactic to keep Jordan present.

NASCAR analyst Bob Pockrass commented on the matter, writing,

"The issue here is whether people who testify during the trial as witnesses can be in the courtroom to hear the other witnesses testify. 23XI can designate one of its owners as its company rep but not all three so NASCAR can request that two can’t sit in before their testimony."

"23XI, in filing today, says it will designate Michael Jordan as its corporate representative, which means he can be in courtroom for all witness testimony. 23XI argues both Hamlin & Polk should be allowed to as well, that they are essential to presentation of their case," he added.

While Hamlin is likely to be exempt from the proceedings, Jordan will be there to fill in for his partner. The JGR driver has also been pretty vocal about his dislike for NASCAR management. He called out the sport for brainwashing its audience with propaganda articles.
