23XI sets strategy to ensure Michael Jordan's presence in court throughout all witness testimonies

23XI has found a loophole to keep Michael Jordan present during the trial hearings. The team has designated Jordan as its corporate representative, making him eligible to witness all testimonies.

Last week, NASCAR had requested the court to withhold the presence of Jordan and Denny Hamlin during the legal proceedings. The motion was filed under a legal rule that restricts figures who may influence the jury.

NASCAR analyst Bob Pockrass commented on the matter, writing,

"The issue here is whether people who testify during the trial as witnesses can be in the courtroom to hear the other witnesses testify. 23XI can designate one of its owners as its company rep but not all three so NASCAR can request that two can’t sit in before their testimony."

He later shared that 23XI has made sure Michael Jordan will be present during the hearings.

"23XI, in filing today, says it will designate Michael Jordan as its corporate representative, which means he can be in courtroom for all witness testimony. 23XI argues both Hamlin & Polk should be allowed to as well, that they are essential to presentation of their case," he wrote.

The antitrust lawsuit has been going for over a year now. The case proceeds to trial on December 1. As part of the discovery process, evidence from both sides have been released, revealing damning remarks that've stirred controversy.

Internal talks showed NASCAR's disdain for rival series like SRX and team owner Richard Childress. Former Cup Series driver Jeremy Mayfield weighed in on the situation and shared that one doesn't 'have to mess up to get targeted' by NASCAR management.

Notably, the 56-year-old was suspended from the sport for failing drug tests back in 2009.


Findings reveal Michael Jordan's stake in Stewart-Haas Racing charter

Team financials that've been released as part of the hearing's disclosure has shed light on Michael Jordan's ownership in Stewart-Haas Racing charter. Jordan and Denny Hamlin's stake in 23XI Racing was also revealed.

"Some Jordan-23XI financial tea from emails/depositions: MJ said he'd pay 60% for SHR charter; Denny would pay 40%"
"Denny and Jordan went 50-50 on 23XI real estate (Airspeed) and MJ fronted Denny the $, with DH paying him back monthly. MJ has loaned the team money for legal fees," he added.

The Michael Jordan-owned outfit looks at an uncertain future amidst the legal dispute. The team is currently contesting as an open entry after a preliminary injuction securing their charter status was overturned. NASCAR has ensured that it won't sell the charters until the case ends.

Nonetheless, the team has ensured financial compensation for its employees through 2026. However, if NASCAR ends up losing, the charter system is bound to see changes.
